What is DACA and What is Its Current Status?

DACA (Deferred Action for Childhood Arrivals) is a federal program that since 2012 has protected young immigrants, known as "Dreamers," who came to the United States as children.

  • ✅ DACA renewals continue to be processed nationwide.

  • ❌ Initial (new) applications remain blocked.

The Legal Context: Why Is There So Much Uncertainty?

  • July 2021: Federal District Judge Andrew Hanen ruled that DACA was unlawfully created.

  • October 2022: The Fifth Circuit Court of Appeals upheld the ruling but sent the case back for further review of a new rule.

  • September 2023: Judge Hanen again blocked new DACA applications.

  • 2024-2025: The case continues in federal courts with no definitive resolution.

What Does This Mean for Current DACA Recipients?

If you already have DACA, you can renew your status. This is currently your most important legal tool. We strongly recommend not waiting until the last minute to apply for renewal.
